Control of the principle of subsidiarity

The Statute of the Seimas establishes that specialised committees of the Seimas, within their remit, are responsible for due and timely control of the principle of subsidiarity.

A specialised committee submits to the Committee on European Affairs conclusions on the compliance of a draft legislative act of the European Union with the principle of subsidiarity within four weeks from the receipt of a draft legislative act or within ten days from the receipt of the Government’s position on the compliance of a draft legislative act of the EU with the principle of subsidiarity. The Legal Department of the Office of the Seimas prepares conclusions on the compliance of a draft legislative act of the EU with the principle of subsidiarity prior to the meeting of the specialised committee.

Having received a request by the Speaker of the Seimas, conclusions of a specialised committee, a request by a political group or a Government’s conclusion on the compliance of a draft legislative act of the European Union with the principle of subsidiarity, the Committee on European Affairs, on its own initiative (or on the initiative of the Chair of the Committee), considers the matter at the Committee meeting within one week. The meeting is also attended by representatives of the specialised committee and the Legal Department of the Office of the Seimas, which presented the conclusions on the compliance of the draft legislative act with the principle of subsidiarity.

Upon the decision that the draft legislative act of the EU may not comply with the principle of subsidiarity, the conclusions by the Committee and the resolution of the Seimas on the reasoned opinion on non-compliance of the draft legislative act with the principle of subsidiarity are forwarded for debate to the plenary sitting of the Seimas.

The conclusions of the Committee on European Affairs on possible non-compliance of the draft legislative act of the EU with the principle of subsidiarity must be submitted for debate at the plenary sitting of the Seimas within one week after their registration at the Secretariat of Plenary Sittings, and, if possible, no later than one week before the expiry of the eight-week period from the date when the draft legislative act of the EU is made available to EU national Parliaments in all official languages of the Union.

The draft resolution of the Seimas on the reasoned opinion on non-compliance of the draft legislative act of the EU with the principle of subsidiarity submitted by the Committee is considered at the plenary sitting of the Seimas subject to a special urgency procedure. The conclusions of the specialised committee and the Committee on European Affairs on non-compliance of the draft in question with the principle of subsidiarity are presented at the sitting.

The resolution of the Seimas on the reasoned opinion on non-compliance of the draft legislative act of the EU with the principle of subsidiarity adopted at the plenary sitting of the Seimas is forwarded to the Government. This resolution of the Seimas is published in the official gazette Valstybės žinios, unless the Seimas decides otherwise.

The Committee on European Affairs is responsible for notifying Presidents of the European Parliament, the Council of the European Union and the European Commission, as well as the national Parliaments of the EU Member States as soon as possible and no later than within a week after its adoption of the resolution of the Seimas.
